a_yaja is 100% right. Is is upto port of entry(POE) officer to decide I-94 expiry date. Usually that will be 3 months to 6 months longer from the POE date.

Isn't it strange that even though Eb3-I PD Mar 04 is not current, they opened the file and sent RFE?
My PD is Mar 2005/EB3 and I was sent an RFE in Jul 2009 since my Birth certificate has initials and not the full name.
I read somewhere, because of the backlog, they do review the cases and in some cases even "approve" them. Once the visa number is available, GC will be issued for these cases.

Yes all those who were not eligible can try now right, if we were to bring this to their notice that we did not get anything last year, will that make a difference.

The RFE was for biographic information of the passport (basically a photo identity matching the name). It appears that my lawyer may have missed sending separate copies of it for each application (485/765/131). Anyway I sent color copies of the passport pages as well as driver license. The status for the application changed to "Response to request for evidence received on 10/09/2007 and processing resumed".
As far as your FP notices, I have read that others have been able to get the notices after calling the Service Center customer service. You might want to consider that.

If L1 quits the job (for what ever reason) and any change in status such as L1 to Fi etc; will automatically invalidates the L2. Meaning L2 status NO LONGER valid

My AP was approved while my wife's it was denied with reason "there is no pending I-485". My PD is 22 Nov 05 which is not yet current so I don't understand why they denied derivative spouses petition while mine was approved. We had an interview back in January and everything went on well there. Did anyone have similar issue? What are my options? I do not want to spend money and file for motion to reopen.

Hi,
I am on H1b visa and it is expiring in sep 2009 in 2 months. I need some information incase i dont get a project in mean time. I already got RFE for the extension.
Is it better to convert to H4 visa? How much it costs? and how long it takes to convert? Also do we get any kinds of problems in converting to h4 visa?
Also if we converted to h4 visa, can we easily get f1 visa if we want to study later or can we go back to h1b from h4 visa.? what all things are required.
Please let me know.

Your question is not clear. H1 is a work visa, H4 is for dependants of H1. F1 is family visa. There are no conversions. You get whichever is applicable to your situation.

From my experience The people at the national center have no idea whats happening when compared to the guys at the specific centers. The national centers issues generic solutions. (Say fill a form and wait for 45 days. If after 45 days there is no answer they again send the form, etc) If you really want to know more or get proper action, the people at the specific centers will have to be contacted.
The old way to get to the specified center is back. Dont listen the messages, just press the order of the buttons and it will work.

Attorney did the work for me. But he asked for 2 photos for AP renewal. The EAD renewal generated a biometrics apppointment within 2 weeks (I am in CA)

The violation rate was even higher in cases involving computer professionals. Twenty-eight of the 104 that were examined, or 27%, had violations of some sort, according to a USCIS report that was finalized in September and publicly released last week by Sen. Chuck Grassley (R-Iowa).
USCIS investigators examined a random sample of the nearly 97,000 H-1B petitions filed in late 2005 and early 2006. They found problems such as forged signatures, fake degrees and the use of shell companies in applications. Other issues were discovered during visits to work sites. For instance, some employers "benched" H-1B holders when work wasn't available or had them doing jobs that weren't listed on their visa applications, the report said.
Fraud indicators
* Businesses with 25 or fewer employees and revenue of less than $10 million had higher rates of H-1B fraud than larger companies did, the USCIS said.
* Of 114 cases involving workers from India, 25% were found to involve fraud or technical violations. No other countries had statistically valid samples.
The report's authors called the level of fraud a "significant vulnerability" for the H-1B program and wrote that the USCIS is making "procedural changes" in response to the findings. An agency spokesman said Friday that possible steps include checking applications against external records and using fraud indicators to flag petitions for increased scrutiny.

One way to deal with the maintenance ugliness, would be to cover it with a foreground object. That way it would feel like the whole bridge was in the picture. Just a thought, not sure how it would turn out.
