My situation,
I am having Bachelor Of Science in Nursing degree from US unviersity.
I have state board nursing license (RN NcLex) from NJ.
Do I still need CGFNS VIsa Screen?

I filed my I-485 in July 07 at Nebraska service center and my wife had her finger printing done a month or so ago but I am yet to get the notice. Is there some number I can call and check. My Lawyer is very uncooperative in this case.

I just received my EAD now. Though I am a 485 july filer, applied for EAD only in January.
My 6 th year H1 will come to end in Oct. Because 180 days since 485 filing is over, I want to use AC21 and change the Employer now, and I am thinking why to go again for H1. I have the EAD, and why not use it, though I will be joining another desi employer.
Does it seem the right thing to do? But everyine else I know changing the employer but again going for H1. Then why at all we have EAD.
I understand that if GC is rejected, and if we are on H1, we don't have to leave. But if GC is rejected, I really don't care. Even if I get the GC, I want to go to Mera Bharath Mahaan.
1. What are your thoughts on this?
2. One thing I am still not clear on is: If EAD renewal is delayed next year, and if I don't receive the approval in time (i.e. before the expiry of my current EAD) will I be out of status because no H1 and no EAD?
3. I am thinking there is no waiting period of 180 days etc from the EAD approval date to join another employer. Please correct me if this wrong.
4. If I use EAD, what is the status of my family without H4?

It's really impossible to answer this without knowing the exact employment relationship that is planned and what the denial said in detail. Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic. Hi Guys,
A quick one. I have a HIb visa which is expiring on 9th of next month . I have never worked for that employer as things did'nt work out. I am currently in Australia and want to work as a contractor in US. I have already figured out who is going to transfer/sponsor my new H1.
I am pretty sure that my employer would have cancelled my h1 which was allotted to me in 2007 quota.
I have a tourist visa as well and i intend to goto US on that Visa and work out on the transfer of my H1 once i land there.
Can i really do the above or am i getting too optimistic.
Please reply soon as i have to make some really quick decisions.

your old H1 would not be of any use/issue for you. Apply for a new one with the new employer and it would be an easy process. Transfering basically means applying for a new one. The employer has to go through all the processes (advert, recruitment, LC etc). I have no idea about converting from B1 to H1.

All,
My 4 years and 2 months on H1B will finish in this November and we are in the process of applying for an extension. I have my 140 approved and waiting for my priority date to become current.
Can I apply for 3 years extension based on my 140 approval? or do I have to apply for 2 yrs extension to finish my 6 yrs first and then eligible to apply for 3 more years (if my priority date is still not current by then?). My HR is under the second impression (2 yrs and then 3 yrs).
Also, please can you specify the USCIS rule under which it is applicable?

You can apply directly for a 3 year extension based on your I-140 approval.

A federal judge in Phoenix on Wednesday blocked key provisions of Arizona's controversial immigration law from taking effect as scheduled Thursday, granting in part an injunction requested by the Obama administration.
U.S. District Judge Susan Bolton ruled that the injunction would apply to the portion of the state law that requires police to try to determine the immigration status of a person they arrest, stop or detain while enforcing other laws if they reasonably suspect the person is in the United States illegally.
In a lawsuit filed against Arizona, the Obama administration said the law was unconstitutional and warned that the provision would result in racial profiling and harassment of U.S. citizens, legal immigrants and foreign visitors.
Bolton said in her ruling that it was "not in the public interest" for Arizona to enforce a provision that preempts federal enforcement of immigration law.
