    I understand there will be stress headache etc... I just wanted to see if the cost of appealing a wrongly rejected 485 was something a H1b employee can afford.
    BTW on lighter note:
    For headache I use zandu balm
    and for stress I do Yoga.
    These dont cost as much as docs/lawyers in this country!!

    Yes, acting without pay is working. You might not receive a benefit in financial terms, but you are getting other benefits - experience, publicity, etc.

    You could try to reopen the case with Supporting evidence of ill health and age. This is a long shot, but a good attroney should be able to pose a compelling argument. Also, try to get an infopass appointment and talk to someone about your options.

    Hello
    Whm i transferred my H1B to another company, i missed filing filing for H4.
    So she was having I 94 of my old company till Nov 2006.
    Whn i changed company agn in Dec 06, thats whn i relised her i 94 expired, we submited I 539 for her xtension. but couldnt get it. she exited the country before 180 days of her expiration and planning to apply for new visa in India.
    Did anybody had the same experience. Pls share.

    Following is the situation:

    My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
    Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
    Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).

    Falling short of 10 weeks to get the 365 days rule

    Options that I learnt for me getting 7th yr extension and staying in the country:

    Option1:
    Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
    File for 7th year extension based on the 365 days rule
    Convert from H4 to H1 and start working.

    Option 2:

    Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
    File for 7th year extension based on the 365 days rule
    Stamping in canada to return to USA.
    (I am hoping 7th year extension can be done while I am outside the country)

    Option 3:

    Go back to India for 3 months wait till June 20th,
    File for 7th year extension based on the 365 days rule
    Stamping in India to return to USA.
    (I am hoping 7th year extension can be done while I am outside the country)


    Option 4:

    Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

    Can the gurus/experts please put in any issues I might be running into or if any of the option above are not at all feasible(may be I am ignorant)

    Hi,
    My 485 status on USCIS site is showing Document production or Oath Ceremony. The status changed on 7/8/2010. What does this status mean. Does this mean approval? How long does it take to recieve the actual card once the case enters to this state.

    Hello guys,
    I am sending my family based I-485 on May 1. currently i am on h1b . My h1b approval (I-797A) is valid till April 15, 2009. my h1b extension is already pending with USCIS. My Question is :::----

    Is there gonna be any problem with USCIS since my h1b approval already expired?? what will be my status after i filled my I-485?? Can i legally stay in US after filing family based I-485 even my h1b extension get denied.???

    It is very possible that my question might have already been answered in the past but after searching through many forums, I could not find a direct answer.

    Here�s my situation:
    Category: EB2
    PERM approved.
    I 140 approved.
    PD � Dec 2007.
    H1-B status: 6 yrs expiring Sep 10. Filed for 3 yr extension.

    I have an excellent chance of a promotion to a managerial level position. I am seriously considering abandoning my current GC process, accept the managerial position and reapplying for a new H1-B and GC.

    Questions:
    1. Will I need a new H1-B? If so, for how many years will I get it?
    2. When I apply for a new PERM, will PD of Dec 2007 still be valid?

    1. You will need a new H1-B with a new LCA appropriate duties and responsibilities, wages etc.

    2. Yes. You can retain the old PD with the I-140. Take care to note that that you are not applying for the PERM but your company will be and your company may or may not find qualified citizens/permanent residents. You do not and should not control the recruitment process.

    I moved from Company A to company B towards the end of my H1 6 th year with only a month and half left in my H1. Company B applied for my 140 and 140 was approved just on the day of my 6 year completion. H1 transfer was filed in parallel in normal processing. H1 transfer has got an RFE now a day after 140 was approved.

    1. Will there be any problems in getting the H1 transfer based on the 140 approval with the new company? Please note that I do not have any days left in my original H1.

    2. What will the duration of H1 if the transfer gets approved?

    3. I am continuing to work based on 140 approval and pending h1 transfer. Please advice is it is ok.

    The data is incorrect. There are a lot of applications not accounted for. See Ron's posts whee the lawyer has done analysis and said that.

    Hi all,

    Need your advise. I have an approved PERM Labor (2006)
    Also filed for I-485 in July 2007, got EAD, AP.

    Lately i noticed that my Date Of Birth is incorrect in page 5 of ETA 9089 Labor Form. This error is in section J Alien Information.

    How should i correct it? Please advise.
