Friends,
I have question for you. How many APs we have to show at POE? One of my friends, he came from Canada, at POE they took 2 APs. They stamped on both of them. One they took and one they gave back to him with stamp.
As of I know. We need to give 1 AP at POE. Is this true?

Best way to tackle this would be to call customer care 1800 # and ask them abt this...

One of my H1B friends went to Frankfurt for some work and expired US visa...The Germans gave him visa because the client is a very large bank in Germany..
I remember that to get the H1B restamped he went to Delhi after he was done in Frankfurt...
If your client in France is big enough and gives you a letter....most likely French would give you visa....They would ask for detailed itenerary...

Why are you going to other forums for advice. Those other forums are after making money from traffic and ads. They want you to suffer as long as possible so that they make money. They even charge per question. You are being anti-IV by visiting other forums. I hope you see the difference between them and IV.

Hello,
My original H1B visa was issued to me on Oct 1st, 2010 and is valid till Sep 30th 2010.
I got a new job in 2009 and they applied for my H1 transfer. It was approved and the new dates on the new I797 are 10/01/2009 till 09/17/2012. I went to India after that and when I returned, I got a new I-94 off course which was stamped to be valid until Sep 30th 2010.
Now I am nearing the end of my original H1B visa issued by my previous employer and stamped on my passport this coming October. I am also planning to go to India in this coming June. Will I will have to get my visa renewal stamping done this time if I go to India? Will I need a new H1B stamp on my passport from my new employer on my passport to come back?
I really appreciate any words of wisdom from all you learned people on this forum. Thanks in advance!

Not that I know ... the worst case scenario is that your green cards are physically mailed to you and then they are returned 'cause nobody was at the home (though normally, it should just sit with your other mail).
When you reenter US, stand in the regular visitor line.... if your card is issued, the IO will know and stamp your passport w temporary green card and allow you in the US.

All,
I am in a bit of confusion and needed some info. I had applied for I-485 during July fiasco and my spouse applied as derivative. We had applied for her H1 extension/transfer through another employer after we filed for I-485 as we did not want her to use EAD. We recently received her H-1 approval without I-94.
I am not sure at this point if she has to leave immediately to get the h1 stamp Or she can continue to stay here as her AOS is pending based on derivative status of my application.
Also will her getting approved without I-94 impact her pending AOS in anyway
what was her status when she applied the 485? I am assuming H1, but did she have an unexpired I-94 at that point? Was she getting a regular paycheck? Do you know why you did not get an I-94 with that H1 extension? Usually the only reason that happens is when you are out of status. Which could be a problem with your AOS... Did you talk to the attorney who filed the H1, what does he say?

This is pretty confusing to me as to what I am can and cannot do with an EAD/AP combination. Right now I am on an H1-B visa. What are the major differences from getting a green card, other than the fact that if the green card is rejected for some reason, I would have to leave the country For example, on EAD/AP, can I:
1. Quit my current job and sit at home, and do nothing?
2. Start a company?
3. Go to Full time MBA school?
4. Go to part time MBA school with my current job?
5. Switch jobs as many times as I want using AC21?

It's up to the employer if he wants to keep you as an employee and has the right to cancel your H1 if he likes to do so. Just because you left the country doesnt mean that your H1 becomes invalid, but again its up to the employer.

I always carry a letter from Employer and I was asked once at Chicago. The letter says I am employed from this day, my job title, salary, visa status and they expect me to return to the employment after the trip. Hope this helps.

Just be honest. For now you can say "No" as it is not full time. If VO asks more question on it tell them "you were not sure and ask them what it needs to be since she is doing part time. Take relavent docuemnts to show she is a part time.
All it needs to get visa is Honesty.

I am in similar situation. If she comes here and we get married "new" and I am GC Holder can she get a GC too ( provided PD is current ) OR I have to wait till I become Citizen and then file ....
